1. Services Provided

FIGBAR Consulting LLC provides digital marketing and website solutions for small and local businesses.
Our services may include, but are not limited to:

• Website design, development, and hosting setup

• Search engine optimization (SEO) and local SEO

• Paid advertising (Google Ads, Meta, and other platforms)

• Reputation and review management

• Social media management and automation

• Marketing audits and performance analysis

• CRM setup and workflow automation (GoHighLevel-based systems)

We reserve the right to modify, pause, or discontinue any service, feature, or pricing plan at any time.

2. Setup Fees, Subscriptions, and Billing

Depending on your service plan, a one-time setup fee may apply for onboarding, design, or campaign setup.
Monthly service fees are billed automatically until canceled.

• Billing details, fees, and renewal dates are clearly displayed at checkout and in your signed agreement.

• If you cancel before the end of your agreed-upon service term, any waived setup fees or promotional credits may be reversed.

• For marketing retainers or website hosting agreements under 12 months, a prorated recovery fee may apply to cover setup and design costs.

3. Cancellations and Refunds

You may cancel your services at any time by written notice to [email protected].
Cancellations before 12 months of active service may result in the recovery fee described above.

Completed setup work, campaign builds, and design services are non-refundable once initiated.

4. Client Responsibilities

Clients agree to:

• Provide accurate, timely business and contact information.

• Supply text, images, and media they own or have rights to use.

• Review and approve deliverables promptly to avoid delays.

• Maintain compliance with all applicable laws, including those governing advertising and data privacy.

We reserve the right to suspend or terminate accounts that misuse our platform, violate these terms, or fail to make payments.

5. Intellectual Property

Unless otherwise agreed in writing:

• All proprietary systems, templates, and marketing frameworks created by FIGBAR Consulting remain our property.

• Clients retain ownership of their original content, branding, and materials.

• Upon fulfillment of all payments and after 12 months of active service, ownership of the completed website design may be transferred to the client.

We reserve the right to use anonymized performance data or screenshots of completed work for portfolio or marketing purposes.

6. Limitation of Liability

FIGBAR Consulting LLC is not liable for indirect, incidental, or consequential damages — including data loss, downtime, or lost revenue.

While we take every precaution to ensure performance and uptime, we do not guarantee uninterrupted service and are not responsible for third-party outages (hosting, ad platforms, automation tools, etc.).

7. Third-Party Services

Our solutions often integrate with third-party providers (e.g., Google, Meta, GoHighLevel, OpenAI, or analytics tools).
Each of these platforms has its own terms and privacy policies, which apply in addition to ours.

You are responsible for reviewing and complying with those third-party terms.

8. Data and Privacy

We respect your privacy and handle client data in accordance with our Privacy Policy.
By using our services, you consent to the collection and use of necessary business and technical information to deliver and improve our services.

9. Modifications to These Terms

We may update or modify these Terms of Service as needed to reflect changes in operations, compliance, or laws.
All updates will be posted on this page with an updated effective date.
Continued use of our services after such updates constitutes acceptance of the revised terms.
